San Diego State U Student Suspended for Assault Sues School

A San Diego State University student suspended following a sexual assault accusation has sued the school over the way it is handling the investigation.

The U-T San Diego newspaper reported Tuesday that an attorney for Francisco Sousa says his client has been denied due process and is not even sure about the specifics of the accusations against him.

The 20-year-old transfer student from Portugal was arrested in December and charged with false imprisonment and forcible oral copulation of a female student. The charges were later dropped, but he remains suspended and has since enrolled in another school.

Sousa’s lawyer has filed a writ of mandate in Superior Court to get access to specific accusations that led to the suspension.

A spokesman says the university does not comment on pending litigation.
