Oregon School District Named in Sexual Assault Suit

November 20, 2014

A federal lawsuit seeks $5 million from the Lincoln County, Ore. school district, alleging that district officials failed to protect a developmentally disabled boy from being sexually assaulted by a classmate on campus.

The Register-Guard reported the lawsuit was filed Tuesday in Eugene by the boy’s court-appointed guardian. The suit alleges that the boy was sexually assaulted more than once by another boy while both attended Taft High School in Lincoln City in 2012 and 2013. Both were enrolled in a class for students with developmental disabilities.

The lawsuit says the attacker pleaded guilty in December in juvenile court to second- and third-degree sexual abuse of the plaintiff.

School district spokeswoman Mary Jo Kerlin said she is unable to comment on any pending litigation.
