Steak ‘N Shake Sues Colorado Franchisee

Steak ‘n Shake Enterprises has filed a lawsuit against a former franchisee in the Denver, Colo. market amid allegations that Denver-area menu prices were allegedly $2 or more above what national ads indicated.

The Denver Post reported the chain filed its lawsuit in U.S. District Court in Denver earlier this month to try to stop the former franchisee from using Steak ‘n Shake logos and menus.

It alleges the family of Kathryn, Larry and Christopher Baerns of Aurora violated their agreement for the exclusive rights to run Steak ‘n Shake restaurants in the Denver market when they allegedly ignored mandatory menu offerings and specific pricing on some items.

The family’s attorney Scott Kannady says he’s confident the franchises will be able to keep running.
