Wife Of Marine Shot By New Mexico State Police Sues
The wife of a troubled Marine veteran who killed himself after being shot by a New Mexico state police officer near Santa Fe two years ago is suing and disputing the police version of the events.
An officer stopped 27-year-old Diego M. Gonzales’s pickup on Interstate 25 after reports he had abducted his wife and 2-year-old son from Pecos.
The Santa Fe New Mexican reported the suit filed Wednesday says Gonzales fired but didn’t point the gun at the officer and stayed in the truck. The suit says officer Bryan Waller shot the veteran of two combat tours in Iraq and Afghanistan twice in the back and he sat in the driver’s seat. Gonzales then killed himself.
A state police spokesman said Saturday the agency doesn’t comment on pending litigation.
