Prison Inmates Sues Over Broken Toe, Seeking $2.2M

A Montana State Prison inmate is suing five prison employees for the physical and mental trauma he says he suffered after getting his foot caught in a grain auger at the prison dairy.

The Bozeman Daily Chronicle reported 40-year-old Robert Webb filed the $2.2 million lawsuit in federal court in Helena on Tuesday.

Webb said he was shoveling grain in December when he slipped. The lawsuit said he was stuck in the auger for at least 15 minutes and it took another 30 minutes to free him. He broke the big toe on his left foot and says he still has trouble getting around.

Webb alleges he was injured because the auger’s safety guard had been removed.

He is seeking damages for future medical costs and any disability that will affect his ability to work.
