Court: California State Fund Legal Staff Entitled to Back-Pay

A San Francisco Superior Court judge has ordered that California’s State Compensation Insurance Fund pay approximately 500 employees back-pay for previously instated furloughs of union workers. The state implemented the furloughs in February 2009.

“The court finds plaintiffs have made an adequate showing of irreparable harm and lifts the automatic stay of its mandatory injunction resulting from respondents’ notice of appeal,” wrote Judge Peter J. Busch, in his ruling in California Attorneys, Administrative Law Judges and Hearing Officesr in State Employment et. al. vs. Arnold Schwarzenegger, Governor of the State of California; David Gilb, Director of the Department of Personnel Administration; John Chiang, Controller of the State; and Jan Frank, President of State Compensation Insurance Fund.
