Texas DWC Adopts Amendments to Accident Prevention Services
The Texas Department of Insurance, Division of Workers’ Compensation (DWC) announced this week that it has adopted amendments the 28 Texas Administrative Code concerning certain submission requirements for insurance companies about their accident prevention services (APS). The rule will be effective July 1, 2024.
The rule, which affects Texas Administrative Code Sections 166.1, 166.2, 166.3, and 166.5, does the following:
- Eliminates overly burdensome reporting requirements that companies must adhere to in order to demonstrate the sufficiency of their APS to DWC.
- Brings the administrative rule requirements more in line with the statutory requirements.
- Updates citations, removes obsolete references, and applies plain language and agency style editorial changes.
The rule will be published in the April 19, 2024, issue of the Texas Register and available at www.sos.state.tx.us/texreg/index.shtml once published.
