Texas Division of Workers’ Comp Accepting Public Comment on 3 Forms

The Texas Department of Insurance, Division of Workers’ Compensation (DWC) announced it is accepting public comments on three proposed new forms:

  • DWC Form-003, Employer’s Wage Statement. This form is necessary to allow employers a way to provide wage information to the insurance carrier to calculate the average weekly wage and issue income benefits to injured employees or their beneficiaries.
  • DWC Form-003ME, Employee’s Multiple Employment Wage Statement. This form is necessary to allow injured employees a way to provide wage information for other employers to the insurance carrier to calculate the average weekly wage and issue income benefits when the injury affects their ability to work.
  • DWC Form-003SD, Employer’s Wage Statement for School Districts. This form is necessary to allow employers a way to provide wage information to the insurance carrier to calculate the average weekly wage and issue income benefits to injured employees that work for school districts or their beneficiaries.

The new forms are not a formal rule proposal under the Administrative Procedures Act. DWC will not treat comments as formal public comments. However, DWC will consider any substantive comment before adopting the new forms. The proposed forms are on the TDI website.

DWC asks that comments be submitted by 5 p.m. CT on June 21, 2022.
