Texas Sets Workers’ Comp Weekly Benefit Rates

The Texas Department of Insurance has announced the weekly benefit rates for workers’ compensation insurance for Oct. 1, 2009, through Sept. 30, 2010.

In accordance with the Texas Labor Code (TLC) §408.047, the workers’ compensation state average weekly wage is equal to 88 percent of the average weekly wage in covered employment as computed each year by the Texas Workforce Commission under TLC §207.002(c).

The workers’ compensation state average weekly wage for dates of injury from Oct. 1, 2009, through Sept. 30, 2010, is set at $772.64. In accordance with TLC §408.061 and §408.062, the maximum weekly benefit rates for workers’ compensation income benefits is set at $773 and the minimum weekly benefit rate is set at $116 for that period.

The maximum and minimum weekly benefit rates for dates of injury from Oct. 1, 2008, through Sept., 30, 2009, were $750 and $112 respectively.
